Terms of service

1. Agreement and eligibility

These Terms are a contract between you and Bypass Inc. ("Fitoon", "we") for the Fitoon iPhone app, the website fitoon.app and related services (the "Service"). By creating an account or using the Service you accept these Terms and the Privacy Policy.

You must be 18 years of age or older. The Service checks your year of birth at onboarding and is not available to anyone under 18. You must not use the Service if you have been diagnosed with, or are being treated for, an eating disorder unless your doctor agrees; see section 9.

2. What Fitoon is (and is not)

Fitoon is a wellness and lifestyle app. It creates a cartoon character from a two-photo body scan or from your height and weight, estimates body measurements, lets you log food, weight and training by talking to Pochi, an AI coach, and shows your progress in a game-like room.

Fitoon is not a medical device and is not intended to diagnose, treat, cure or prevent any disease or condition. All measurements, body-fat percentages, calorie and nutrient values and plan targets are estimates. The published scan accuracy is approximately ±3 cm; results depend on lighting, clothing and phone placement.

3. Your account

• You create an account with an email address and password, or with Sign in with Apple or Sign in with Google. Use the same method to sign in on a new device.
• One account per person. Keep your password, your device and your Apple or Google account secure; you are responsible for activity on your account.
• Provide accurate height, weight and age. Safety limits depend on them.
• We may suspend or close accounts that break these Terms, abuse Pochi or other users, or attempt to interfere with the Service.

4. Plus and Pro subscriptions, trial and payments

• Plus and Pro are auto-renewing subscriptions sold through Apple's App Store, each monthly or yearly: Plus at ¥1,490 per month or ¥10,340 per year, and Pro at ¥2,990 per month or ¥20,690 per year (tax included; prices in other countries follow App Store tiers and are shown before purchase).
• Both paid plans include a 7-day free trial for new subscribers. Unless you cancel at least 24 hours before the trial ends, the plan starts and you are charged the price of the period you chose.
• Each plan includes a monthly budget of AI credits, the units Pochi spends to read, think and reply, plus the feature limits shown on the pricing page. When a budget or limit is reached, the related feature pauses until the next month or until you upgrade; unused credits do not roll over.
• Subscriptions renew automatically at the then-current price until cancelled. Cancel at any time in iPhone Settings → Apple Account → Subscriptions; access continues until the end of the paid period.
• Payments, receipts and refunds are handled by Apple under Apple's terms. We cannot issue refunds directly. Deleting the app or your Fitoon account does not cancel a subscription.
• We may change prices, credit budgets or plan features with notice in the app; changes apply from your next renewal.
• Referral rewards (for example bonus coins when a friend signs up with your invite code) are promotional, have no cash value and may be changed or withdrawn.

5. Coins, items and badges

Coins are earned in the app by logging, scanning and reaching goals, and are spent on cosmetic items for your cartoon and room. Coins and items are licensed to you for use within the Service only. They have no monetary value, cannot be bought with real money, sold, transferred or exchanged, and may be adjusted, expired or removed when we change the Service or close your account. Some items are available only to Pro subscribers or for limited periods.

6. Acceptable use

• Do not use the Service for anyone other than yourself, or scan another person without their consent.
• Do not upload unlawful, harassing or sexual content, or attempt to make Pochi produce it.
• Do not reverse engineer, scrape, overload or interfere with the Service, or circumvent plan limits, credit budgets or safety limits.
• Do not harass other users in challenges or impersonate anyone.
• Do not use shared content to make misleading health or weight-loss claims.

7. Your content and sharing

You own the photos, logs and messages you provide. You grant us a licence to store and process them to run the Service for you, including sending text and meal photos to the AI providers named in the Privacy Policy, and to render your cartoon, videos, cards and stickers at your request.

Shared content is cartoon-only: the Service never includes your real photos in videos, cards or stickers. Statistics are hidden by default and you decide which to show. You are responsible for what you post elsewhere. If you publish before/after content from Fitoon, include a note that results vary by person (効果には個人差があります) as required by Japan's Act against Unjustifiable Premiums and Misleading Representations.

The Fitoon name, Pochi, the cartoon style, room assets, music and software are our intellectual property or licensed to us. You may share content rendered by the app, including its watermark, for personal, non-commercial purposes.

8. Pochi and AI limitations

• Pochi is an automated AI coach. It can misunderstand you, misidentify food, and make mistakes in numbers and advice. Always check important entries and use your own judgement.
• Calorie and nutrient values are estimates from a food database or from an AI estimate, and are labelled as such.
• Pochi does not provide medical, nutritional-therapy or medication advice, including advice about GLP-1 or other weight-loss medication. It will decline such questions and suggest you speak with a doctor.
• Pochi is not an emergency service. If you are in danger or in crisis, contact local emergency services or a crisis line.
• We may change the models and providers behind Pochi over time.

9. Health and safety

Consult a doctor before starting a weight-loss plan if you have a medical condition, are pregnant or breastfeeding, take medication, or are under medical supervision. Stop and seek medical advice if you feel unwell.

For your protection the Service enforces safety limits: a daily calorie floor, a maximum planned loss rate of about 1% of body weight per week, no goal weight below a BMI of 18.5, and no weight-loss mode for users whose BMI is already below 18.5. These limits are not medical advice and may not be appropriate for you.

If a conversation suggests disordered eating, Pochi switches to a supportive mode and shows resources such as consultation lines listed by Japan's Ministry of Health, Labour and Welfare. These resources are provided for information only.

10. Ending the agreement

You can stop using the Service and delete your account at any time in Settings → Delete account (see the Delete your account page). We may suspend or terminate access for violations of these Terms, with notice where practical. On termination your licence to coins and items ends and your data is deleted as described in the Privacy Policy.

11. Disclaimers and limitation of liability

The Service is provided "as is". To the extent permitted by law we do not warrant that measurements, estimates or advice are accurate, that you will lose weight, or that the Service will be uninterrupted or error-free.

To the extent permitted by law, our total liability to you for any claim arising from the Service is limited to the amount you paid us in the 12 months before the claim. We are not liable for indirect, special or consequential damages. Nothing in these Terms limits liability for intentional misconduct or gross negligence, and nothing excludes rights that cannot be waived under the Japanese Consumer Contract Act (消費者契約法) or other applicable consumer law.

12. Changes to these Terms

We may update these Terms when the Service changes or the law requires. We will notify you in the app at least [14] days before material changes take effect; continuing to use the Service after that date means you accept the new Terms. If you do not agree, stop using the Service and delete your account.

13. Governing law and disputes

These Terms are governed by the laws of Japan. Any dispute will be subject to the exclusive jurisdiction of the [Tokyo District Court] as the court of first instance, without prejudice to mandatory consumer protections in your country of residence. If these Terms are translated, the Japanese version prevails once published.
